Legislative Update

We're still in the budget negotiation process. As mentioned previously, the House and Senate named their conferees—point people who are a part of negotiating what the final product between the House and Senate budget will look like. Both the House and Senate have passed their budgets and are in the process of deciding what will be included or excluded from that final budget product. Stay tuned for updates on the budget negotiation process.

Some bills moved this week, which include:

 SB228 – Allow Employers to Offer EPO Benefit Plans. The NCMS expressed concerns to both the House Insurance Committee and House Health Committee. These exclusive provider organization plans (EPOs) already exist in North Carolina. Our concern was that we needed additional rules for these specific plans as they function in the state.

Ultimately the decision was made not to add any amendments to this bill. It moved through House Health and the House floor, receiving a concurrence vote on last Thursday in the Senate. The bill has been sent to the governor.

HB608 — Dignity for Women Who are Incarcerated. This bill is back on the House side for a House concurrence vote. We’re continuing to follow this bill closely and are asking the House to concur on this bill.

SB711 – NC Compassionate Care Act, more commonly referred to as the ‘medical marijuana bill.’ This is the bill we've talked about several times. It’s been through several committees and received a favorable vote in the Senate Health Care Committee last week, with a lot of discussion. Three different amendments were added to this bill. This Wednesday we’re hosting a virtual event, The Importance of Grassroots Advocacy—How You Can Make a Difference. This will be an in-depth conversation on what it's like to be an elected official.

LEAD Conference: Call for Resident/Student Poster Abstracts

The North Carolina Medical Society invites residents, fellows and medical students, to submit posters detailing original clinical research or clinical vignettes to our 8th annual poster competition. Accepted posters will be judged by a panel of North Carolina health care professionals. The winners will be announced at the 2021 NCMS Virtual LEAD Conference and be given a cash prize.

Please coordinate your participation with your Training Program Director and submit a poster abstract to Megan Eberle at the NCMS via email to [email protected] no later than September 13, 2021.

Please note the following instructions:

  1. Abstract Eligibility: Original abstracts that either have or have not been presented at other meetings will be considered. They are eligible if they have been published; however, abstracts based upon full papers that have been published are not eligible.
  2. Abstract Format: Title should be brief and clearly state content of paper. List name and degree for each author. Organize body of abstract as follows: (a) Purpose for study, (b) Simple statement of methods, (c) Summary of results, (d) Statement of discussion, (e) Statement of conclusions, (f) List of references.
  3. Poster Presentation: Each accepted poster will be asked to provide an audio recording to walk attendees and judges through your presentation. Click here for instructions to audio record over a PowerPoint presentation.

NC Medical Board Review Panel Opportunity

The NCMS has the opportunity to fill a vacancy on the NC Medical Board Review Panel. The Review Panel was established in 2008 by state statute to review all applicants for the physician, physician assistant, and nurse practitioner positions on the North Carolina Medical Board. The Review Panel reviews applicants under criteria established by the statute. The Review Panel operates under its own Bylaws.

As part of the NCMS’ Healthy NC initiative, we will be hosting a Lifestyle Medicine Summit as part of the NCMS Foundation’s Community Practitioner Program Annual Meeting on September 24-25. The purpose of this summit is to provide an introduction to Healthy NC and build knowledge and awareness around Lifestyle Medicine as a branch of medicine that, based on extensive research, focuses on lifestyle factors in the prevention, treatment and reversal of diseases. CME Credit Statement

The Southern Regional AHEC designates this live activity for a maximum of 9.75 AMA PRA Category 1 Credit(s) ™. Physicians should claim only the credit commensurate with the extent of their participation in the activity.

Additional Credit

Other health professionals will receive Southern Regional AHEC CEU and/or contact hours and a certificate of attendance from an AMA PRA Category 1 ™ activity. Connecting Patients with Community Health Programs

In keeping with the NCMS’ commitment to help you connect patients to community resources to enhance their health, we alert you to an organization helping to do just that – Healthy Aging NC. This statewide resource seeks to bridge the gap between physicians and PAs and the evidence-based community health programs they support statewide.

Healthy Aging NC connects people to programs and agencies that improve community health, increases the capacity of providers to offer these programs, maintains a website with program information and an online registration system, and analyzes data to report results. Healthy Aging NC’s partners include the 16 NC Area Agencies on Aging, which are often able to leverage federal funding to offer these programs at low or no-cost to participants.

NCMS Town Hall Survey Results Are In

Thank you to everyone who completed our first NCMS Town Hall Survey last week. As promised, here is a brief summary of the results of the quick, 3-question survey.

What is the biggest issue facing your practice today?

Staffing shortages came up most frequently as the biggest challenge. In particular, practices are weighing the costs and benefits of mandating vaccination against COVID-19 while maintaining adequate staff.

“We have staff who don’t want to get the COVID-19 vaccine, yet we want to mandate vaccinations. So, it is a balance between losing valuable staff and being able to adequately staff the clinic along with the clear benefits of getting everyone vaccinated,” wrote one respondent.

Another person wrote the biggest issue is “hiring enough nursing staff; we cannot even begin giving COVID vaccine in the current nursing workforce environment in our eastern semi-rural location.”

What is the biggest issue facing your patients today?

Cost of care and COVID were the top issues noted in response to this question.

What is the biggest current challenge to your well-being as a health care professional?

Overwhelming demands on your time and feeling unappreciated seem to be the biggest challenges to well-being among the respondents.

“Dealing with patients’ expectations and their complaints while rarely hearing appreciation for the hard work of all the clinic staff and myself,” one person wrote.

“Overwork/burnout due to inability to satisfy patients’ needs (demands), worsened by pandemic,” another wrote.

We hear you and value this input as we, as your professional organization, strive to address your needs.

CMS Expands Medicare Payments for At-Home COVID-19 Vaccinations

As part of the Biden-Harris Administration’s ongoing commitment to increasing access to vaccinations and improving health equity, the Centers for Medicare & Medicaid Services (CMS) is expanding opportunities for people to receive COVID-19 vaccinations in their home. To ensure Medicare beneficiaries who have difficulty leaving their homes or are otherwise hard-to-reach can receive the vaccination, health care professionals can now receive additional payments for administering vaccines to multiple residents in one home setting or communal setting of a home.

NCHA Virtual Town Hall

The North Carolina Healthcare Association is hosting a free virtual town hall TODAY, Thursday, August 26 at 1 p.m. on “Building Healthier Rural Communities.”

Panelists will include leaders from Appalachian Regional Healthcare System, Cape Fear Valley Health, Hugh Chatham Memorial Hospital, and the North Carolina Rural Center. The discussion will touch on how COVID-19 is affecting North Carolina’s rural hospitals, among other topics. There will be time for audience Q&A.

Medicaid Out-of-Network Flexibilities Extended

In an effort to ensure optimal access to care for Medicaid beneficiaries, to support providers during the recent COVID-19 surge, and to alleviate potential provider payment concerns, NC DHHS and the prepaid health plans (PHPs) have agreed to extend the policy for out of network flexibilities to providers who have not yet contacted with a PHP through Nov. 30, 2021. These flexibilities were originally expected to sunset on Aug. 30, 2021.

Under this policy, the PHPs have agreed to:

  • permit uncontracted, out of network providers enrolled in NC Medicaid to follow in network provider prior authorization rules and may continue to get a prior authorization retroactively (This exception does not apply to concurrent reviews for inpatient hospitalizations which should still occur during this time period);
  • reimburse out of network providers at the in-network rate of 100 percent of the Medicaid fee schedule;
  • delay implementation of the 90 percent rate reduction following good faith contracting provision;
  • allow beneficiaries to change their Primary Care Provider for any reason; and
  • extend flexibility for Non-Emergency Medical and Non-Emergency Ambulance Transportation providers through November 2021.

During this period, NCDHHS will allow for beneficiaries to change PHPs as needed. Additionally, PHPs will work to expedite hospital discharge to skilled nursing facilities and rehabilitation facilities to allow for increased bed capacity in the hospitals.

Medicaid has traditionally experienced high provider enrollment rates, which everyone wants to continue. Health systems and all health care professionals are strongly encouraged to continue contract negotiations with PHPs and finalize contracts as soon as possible as the NCDHHS expects this will be the final extension.

The latest episode of the North Carolina Medical Board (NCMB) podcast, MedBoard Matters, features an interview with Betsey Tilson, MD, MPH, State Health Director. In this episode, Dr. Tilson talks about why it’s so important to get vaccination rates up in North Carolina and how pivotal you and all health care providers are to this effort. Dr. Tilson also shares information about several tools to help shape conversations for patients who have been reluctant to get vaccinated.

COVID-19 Vaccines While Pregnant or Breastfeeding

On August 11, the CDC updated guidance for COVID-19 vaccines while pregnant or breastfeeding to recommend that all people aged 12 years and older, including people who are pregnant, breastfeeding, trying to get pregnant now, or might become pregnant in the future, receive the COVID-19 vaccine. Pregnant and recently pregnant people are more likely to get severely ill with COVID-19 compared with non-pregnant people. Getting a COVID-19 vaccine can protect pregnant and breastfeeding people from severe illness from COVID-19.

Evidence about the safety and effectiveness of COVID-19 vaccination during pregnancy has been growing. These data suggest that the benefits of receiving a COVID-19 vaccine outweigh any known or potential risks of vaccination during pregnancy. There is currently no evidence that any vaccines, including COVID-19 vaccines, cause fertility problems in women or men.

Legislative Update

This week budget conferees were named and will continue their negotiations over a state spending plan in the coming week. A side-by-side comparison of both the House and Senate budgets is available on our NCMS legislative blog.

While the budget process is underway, a number of other bills are still making their way through committees. These include:

SB257 -- Medication Cost Transparency Act, which seeks to regulate pharmacy benefit managers. This bill passed both House Health and on the House floor with the copay accumulation language that is included. It moved to the Senate, but the Senate did not concur. Stay tuned as we continue to follow this bill.

HB608 -- Dignity for Women Who are Incarcerated. We are working closely with the NC Obstetrical and Gynecological Society on this legislation.

SB711 - NC Compassionate Care Act, more commonly referred to as the 'medical marijuana bill,' headed back to the Senate Judiciary Committee for discussion. We’ll continue to update you on the status as the bill continues to move through the process.

SB228 -- Allow Employers to Offer EPO Benefits. The NCMS spoke against this legislation, which would allow narrow networks, in committee last week. This bill’s next stop is in the House Health Committee. We’ll likely see some of the changes we’re proposing and advocating for, should the bill continue to move forward.

Third COVID-19 Vaccine Available

On August 12, 2021, the FDA modified the Emergency Use Authorizations (EUAs) for Pfizer-BioNTech COVID-19 vaccine and Moderna COVID-19 vaccine to allow for administration of an additional dose (e.g., a third dose) of an mRNA COVID-19 vaccine after an initial two-dose primary mRNA COVID-19 vaccine series for certain immunocompromised people (e.g., people who have undergone solid organ transplantation or have been diagnosed with conditions that are considered to have an equivalent level of immunocompromise). The age groups authorized to receive the additional dose are unchanged from those authorized to receive the primary vaccination series:

  • Pfizer-BioNTech: ages ≥12 years
  • Moderna: ages ≥18 years

Emergency Rural Health Care Grants

American Rescue Plan Act

The Emergency Rural Health Care program is designed to help broaden access to COVID-19 testing and vaccines, rural health care services, and food assistance through food banks and food distribution facilities.

Rural health care is challenged by immediate financial needs stemming from COVID-19 related expenses. Long-term access to – and availability of – rural health care services have been further hampered as a result of the COVID-19 pandemic. In response to these challenges, this program offers two tracks of funding to eligible applicants.

  • Track One: Recovery Grants provide immediate relief to address the economic conditions arising from the COVID-19 emergency
  • Track Two: Impact Grants advance ideas and solutions to solve regional rural health care problems to support the long-term sustainability of rural health

Eligible applicants include public bodies, community-based nonprofits, and federally-recognized Tribes. Facilities and projects supported through this grant must be located in rural areas with populations of 20,000 or fewer, and must primarily serve rural areas.

Mountain Area Health Education Center CEO Announces Retirement

After nine and a half years leading the Mountain Area Health Education Center (MAHEC), Jeffery Heck, MD, has announced plans to retire as CEO of the Asheville-based academic health center and safety net provider. MAHEC is the largest nonprofit in Western North Carolina (WNC) and one of nine area health education centers dedicated to improving health across the state. MAHEC’s clinical practices support approximately 200,000 patient visits per year. As MAHEC’s president and CEO since 2012, Heck led the organization through a threefold expansion, increasing the nonprofit’s annual operating budget from $30 to $100 million and the number of employees from 300 to more than 900.

MAHEC’s board of directors remains committed to the organization’s mission and is actively searching for a chief executive who can guide the organization’s strategic growth, identify opportunities in the midst of challenges, and lead healthcare transformation at all levels.

HHS Renews COVID-19 Public Health Emergency Declaration 

On July 20, Xavier Becerra, Secretary of the Department of Health and Human Services (HHS), issued a 90-day renewal of the existing COVID-19 Public Health Emergency (PHE). The renewal is largely procedural in nature given that the Biden Administration has previously indicated they anticipate the PHE to continue through the end of 2021. The PHE was first declared on January 27, 2020, and has been subsequently renewed six times since that date. The PHE provides HHS with the ability to waive a host of existing regulations given the extraordinary circumstances physicians face. Most of these waivers terminate with the end of the PHE, though it remains to be seen which the Biden Administration will choose to continue, eliminate, or otherwise modify. Many of these decisions, such as those related to flexibilities provided for telehealth services, will require Congressional action to be extended or made permanent. While CMS has finalized the extension of certain telehealth flexibilities through the end of the year in which the PHE ends (and proposed extensions until the end of CY 2023 in the 2022 Medicare Physician Fee Schedule Proposed Rule), there remains a gap in the ability to provide telemedicine services using audio-only technology and appropriate reimbursements for these services. Physicians Advocacy Institute (PAI) continues to advocate for physicians in private practice to be allowed to permanently use telehealth technologies to engage with their existing patients when access to facilities is limited or care can be delivered remotely. The reimbursement for this care should be equitable with face-to-face care reimbursement.

CMS has contracted with Acumen, LLC to develop episode-based cost measures for their potential use in the cost performance category of the Merit-based Incentive Payment System (MIPS). As part of Wave 4 of measure development, Acumen convenes Clinician Expert Workgroups (“workgroups”) to provide input on all components of cost measure specifications.

Acumen is hosting part-day virtual Service Assignment and Refinement (SAR) Webinars August 23 – September 1, 2021, that will be open to the public with a listen-only option. On Behalf of Susan G. Komen: Research Study on Patterns of Breast Cancer Care Across North Carolina

You are invited to partner with Susan G. Komen for a research study on patterns of breast cancer care across North Carolina.

This project is a collaboration between Susan G. Komen, the North Carolina Area Health Education Centers (AHEC) Program, and the UNC Lineberger Comprehensive Cancer Center, and conversations with community stakeholders in the breast cancer care delivery system, like yourself, will be vital to its success.

This research study will create a comprehensive geographic picture of variations in breast cancer care in North Carolina, and identify the unique unmet needs of breast cancer patients in local communities. To help draw this picture accurately, the researchers are asking you for two things:

  1. Participate in a one-time phone or video interview (approximately 45 minutes to an hour) to reflect on the patterns of breast cancer care in your community.
  2. Help identify breast cancer patients who would participate in a focus group to discuss their experiences with cancer care, to be held in early 2022.

As part of the one-time interview, they will share with you a brief report curated using insurance claims, cancer registry, and other data, on breast cancer care, for your area of North Carolina and the state as a whole, and ask you to help in understanding these trends.

They will also discuss your observations about breast cancer care in your community. If you’re willing to partner with them for an interview, please contact Sarah Bailey at 919-610-6849. Interviews will be scheduled over the next three months.

COVID-19 Vaccines Additional Doses: Codes & Payment

The FDA amended the emergency use authorizations (EUAs) for both the Pfizer BioNTech COVID-19 vaccine and the Moderna COVID-19 vaccine to allow for an additional dose in certain immunocompromised people.

Effective August 12, 2021, Centers for Medicare & Medicaid Services (CMS) will pay to administer additional doses of COVID-19 vaccines consistent with the FDA EUAs, using CPT code 0003A for the Pfizer vaccine and CPT code 0013A for the Moderna vaccine. CMS will pay the same amount to administer this additional dose as paid for other doses of the COVID-19 vaccine (approximately $40 each).

CMS will hold and then process all claims with these codes after completed claims system updates (no later than August 27).

NC Commission for the Blind Call for Nominees

The Physicians Foundation Releases New Survey on Physician Practice and Wellbeing

The Physicians Foundation recently released the results of a national survey, which finds that more than half (55%) of physicians know a physician who has considered, attempted or died by suicide in their career. The 2021 Survey of America’s Physicians, COVID-19 Impact Edition: A Year Later examines how COVID-19 has affected the nation’s physicians more than a year since the start of the pandemic, from increased burnout rates to the continued epidemic of physician suicide.

NC Medicaid Annual Visit Limitations

The Code of Federal Regulations (CFR) defines the services that must be provided by each state Medicaid program. These services are mandatory services. Each state may decide which, if any, optional services, as defined by the CFR, will be covered. Optional services that are covered by the NC Medicaid Program include optometry, chiropractic services and podiatry.

According to the Centers for Medicare & Medicaid Services (CMS), a visit limit may not combine both mandatory and optional services.

NCMS Legislative Update

Last week, in a unanimous vote, HB96, Pharmacist Approved Public Health Needs, moved through Senate Rules and on the Senate floor. The bill hasn’t changed since we saw it last in Senate Health Committee, where there were two big amendments that included one important provision: a requirement for emergency use authorized vaccines to require parental consent for your patients under 18. This bill is going back to the House for a concurrence vote. We’ll update you when this vote occurs and its outcome.

Parts of the House budget were released last week. Each subcommittee met last Thursday to give an overview of their budget. We paid close attention to the Health Appropriations Committee. There were no amendments to the Health Appropriations budget as currently written; however, there may be some as the process continues. Stay tuned to the NCMS Morning Rounds and our Legislative blog for a summary that will outline the entire budget. Until then, you can find House Budget Information from the House Health Appropriations Committee here.

We saw funding for the East Carolina University Telepsychiatry Program that we’ve been supportive of, included in our legislative priority list, as well as funding for health departments. These are two big wins we’ve seen in the House budget so far.

There are several things that were included in the Senate budget that aren’t included in the House budget. One is the surprise billing language we’ve mentioned previously. We are thrilled this policy provision was excluded from the House budget.

We’re likely to see a vote on this next week, so stay tuned.

Confirming Medicaid Coverage for Beneficiaries

NC Medicaid has received reports of confusion in the field by clinicians and pharmacies when members do not present an ID card or when presented with a Medicaid member ID card that differs from the data shown in the NCTracks system. To mitigate any confusion associated with newly issued Medicaid Managed Care member ID cards, clinicians and pharmacies should always use NCTracks Recipient Eligibility Verification/Response to confirm eligibility and not rely solely on the information shown on a Member ID Card. Follow the steps in this Medicaid bulletin when an NC Medicaid or NC Health Choice member presents at your office.

Carolina Complete Health Network Case Study

Given the recent transformation of the state’s Medicaid system, many medical groups are still weighing up what it takes to be designated by the state as a Tier 3 Advanced Medical Home. Organizations with this designation receive funding to perform certain care management functions, such as patient risk stratification and care needs screening. A Carolina Complete Health Network case study illustrates one path forward: it takes time, leadership commitment, and sometimes a little help from partner organizations. The enhanced ability to serve patients made this investment worth it.

New Prior Authorizations (PA) Required for Substance Use Disorder Prescriptions

To ensure a smooth transition of care during NC Medicaid Managed Care launch, plans were required to ingest existing PAs to reduce administrative burden and improve patient experience, with the exception of PAs subject to 42 CFR Part II. Clinicians will need to resubmit previously approved pharmacy PAs to the member’s new health plan. NCTracks will be doing outreach to impacted clinicians who will need to resubmit prior authorizations (PA) for services subject to 42 Code of Federal Regulations (CFR) Part II.

Q&A: What is 42 CFR Part II?

42 CFR Part II regulations prohibit the disclosure of patient records absent patient consent. Disclose means to communicate any information identifying a patient as being or having been diagnosed with a substance use disorder (SUD), having or having had a SUD, or being or having been referred for treatment of a SUD. Records include information regarding diagnosis, treatment, referral for treatment, billing information, emails, voice mails and texts. Withdrawal management means the use of pharmacotherapies to treat or attenuate signs and symptoms arising when heavy and/or prolonged substance use is reduced or discontinued.

Prepaid Health Plan Flexibility for Prior Authorizations During First 60 Days After Managed Care Launch

In response to clinician confusion about prior authorization requirements under managed care, NC DHHS announced the following solution to provide increased flexibility around Prepaid Health Plans’ prior authorizations for the first 60 days after managed care launch:

  1. Between July 1 and Aug. 30, 2021, medically necessary services that normally require prior authorization will still be reimbursed at 100% of the NC Medicaid fee-for-service rate for both in- and out-of-network clinicians.  To ensure that clinicians fully understand each PHP’s prior authorization requirements during the transition, the PHPs will still process and pay for these services if:
  2. a clinician fails to submit prior authorization prior to the service being provided and submits prior authorization after the date of service, or
  3. a clinician submits for retroactive prior authorizations.
  4. This exception does not apply to concurrent reviews for inpatient hospitalizations which should still occur during this time period.
  5. Beginning Aug. 31, 2021, the PHP may deny payment for services that require prior authorization.  For in-network clinicians this will apply to those services that normally require prior authorization. Out-of-network clinicians will need to seek authorizations for all services.
  6. The Department expects all clinicians to maintain scheduled medical care for beneficiaries through this transition.

The Department expects the PHPs and clinicians to continue to work to resolve any outstanding contracting barriers during this time to mitigate out-of-network challenges.

Latest COVID-19 updates from the NC Department of Health and Human Services

With COVID-19 cases again on the rise due to the more contagious Delta variant of the virus, here is the latest guidance from the state and the federal Centers for Disease Control and Prevention (CDC). You can keep up with all state COVID-19 updates at this website.

  • The NC Department of Health and Human Services (NCDHHS) announced last week that anyone who works or volunteers at a state-run health care facility in North Carolina will need to be fully vaccinated against COVID-19 by the end of September. NCDHHS also urged private facilities to follow suit. Several large health systems did announce vaccine mandates for employees.
  • The state will begin verifying COVID-19 vaccination status for all its employees and those state workers  who are not vaccinated are required to wear a mask and be tested at least once a week, as announced last week by Gov. Roy Cooper and NCDHHS Secretary Mandy Cohen, MD, MPH.
  • NCDHHS – and the NCMS – strongly urge all North Carolinians age 12 and older to get a COVID-19 vaccine. Data shows that the rapid increase in COVID-19 cases is largely due to those who are unvaccinated.

The Governor and Secretary Cohen also released updated guidance for the state’s K-12 students, which urges that everything possible be done to keep students in schools and emphasizes continued masking. This guidance became effective July 30. Review the guidance here.

NCMS Legislative Update

Most legislators were away last week, attending a national meeting that included a number of legislators from across the country there to discuss a variety of concerns, including some health-related issues. We’ve included a link to the Health Related Draft Policies at American Legislative Exchange Council (ALEC), so you can learn more about the discussion on those particular issues that may pop up next legislative session.

Recently, we sent out an action alert to you concerning a congressional action regarding Medicare rate cuts that are almost at 4%. WE NEED YOUR HELP! While legislators were away at the conference, we held meetings with some House members on the budget. We’re expecting the House budget to come out the second week in August.

This week, some committee meetings have already been scheduled. One issue that is up is SB 257. This is the Pharmacy Benefit Manager (PMB) regulation bill that has been well-vetted. It’s been through several committees, both on the House and Senate side. However, legislators are considering additional language to include in this bill that the NCMS is supportive of. This is Copay Accumulator Adjustment language.

Copay Accumulator Adjustment language is important because it ensures that all payments count that are made on the behalf of patients toward their out-of-pocket maximums or their deductibles. Some version of this language has already passed in Georgia, Virginia, and Tennessee. Again, the NCMS is in support of this language. It allows patients to get to those maximums faster.

Most North Carolina health insurers are now implementing “copay accumulator adjustment programs," which prohibit copay assistance from any third-party, including a church, foundation, GoFundMe, or copay card, from counting toward a patient’s annual deductible or out-of-pocket maximum.

This means any third-party copay assistance will reduce a patient or family's cost sharing burden, and means that copays are paid twice: once from copay assistance and again from the patient or family. It's not fair and only pads the pockets of health insurers and PBMs.

We must include protections against copay accumulator adjustment programs in Senate Bill 257, which is currently being considered by the NC General Assembly.

LEAD Conference: Call for Resident/Student Poster Abstracts

The North Carolina Medical Society invites residents, fellows and medical students, to submit posters detailing original clinical research or clinical vignettes to our 8th annual poster competition. Accepted posters will be judged by a panel of North Carolina health care professionals. The winners will be announced at the 2021 NCMS Virtual LEAD Conference and be given a cash prize.

Please coordinate your participation with your Training Program Director and submit a poster abstract to Megan Eberle at the NCMS via email to [email protected] no later than September 13.

Please note the following instructions:

  1. Abstract Eligibility: Original abstracts that either have or have not been presented at other meetings will be considered. They are eligible if they have been published; however, abstracts based upon full papers that have been published are not eligible.
  2. Abstract Format: Title should be brief and clearly state content of paper. List name and degree for each author. Organize body of abstract as follows: (a) Purpose for study, (b) Simple statement of methods, (c) Summary of results, (d) Statement of discussion, (e) Statement of conclusions, (f) List of references.

National Core Indicators™ (NCI) Staff Stability Survey for 2020 Available

You are encouraged to complete the National Core Indicators™ (NCI) Staff Stability Survey for IDD Clinicians. It is vitally important that issues affecting the IDD DSP workforce are known. Temporary Provider Rate Increases and Clinical Policy Changes Extended

NC Medicaid is extending COVID-19 temporary clinician rate increases for all health care professionals except hospitals through Sept. 30, 2021. While the rate increases for clinicians authorized under SL 2020-4 were set to expire on June 30, 2021, NC Medicaid has discretion to continue these and other temporary rate increases assuming budget availability. NC Medicaid will continue to provide updates in September on the status of these increases. As previously communicated in Medicaid COVID-19 Special Bulletin #171, COVID-19 temporary clinician rate increases applicable in NC Medicaid Direct (formerly known as fee-for-service) will also apply in managed care (Standard Plan PHPs and LME-MCOs). NC Professionals Health Program (NCPHP) Call for Nominees

The NCMS has an opportunity to appoint a new member to the NC Professionals Health Program (NCPHP) Board of Directors. Learn more about responsibilities of NCPHP Board members.

Since 1988, NCPHP has been dedicated to helping medical professionals experience a lifetime of change and return to health. NCPHP assists with recovery from substance use disorders and other conditions that could impair a clinician’s ability to safely provide care and services to their patients.

NCPHP originated as a physicians’ health committee of the North Carolina Medical Society (NCMS). In 1988, it was established as a formal program of the NCMS and written into the North Carolina General Statutes. To learn more about the important work of this organization, visit the NCPHP website.

Advocate Against Medicare Cuts!

The proposed 2022 Medicare Physician Fee Schedule imposes payment cuts to Medicare providers and will adversely impact patient access to care. Act now to voice your opposition!

CMS recently released the 2022 Medicare Physician Fee Schedule and Quality Payment Program proposed rule. The proposed rule reduces the 2022 Medicare conversion factor by approximately 3.89%.

The conversion factor determines increases or decreases to overall payment rates in the physician fee schedule.

This reduction is a result of the expiration of the 3.75% increase to the conversion factor used to calculate payments at the end of calendar year 2021 that was implemented through congressional action at the end of 2020 in the Consolidated Appropriations Act.

Without intervention, the cuts will go into effect January 1, 2022.

Please join us and your colleagues in expressing opposition to these changes!

Contact your congressional offices now to encourage Congress to stop the proposed Medicare cut.

CDC Reports 1st Cases of Untreatable Fungus, Becker’s, 7-23-21

Breathe Easy NC: Becoming Tobacco Free, November 17, 2021,12:00-5:00pm EST

This training will assist behavioral health leaders and practitioners make behavioral health facilities 100% tobacco free and will improve their skills in providing evidence-based tobacco use treatment concurrently with mental health and substance use disorder treatment. Attendees will receive the information and skills needed to prepare for the NC Medicaid tobacco-free policy requirement that goes into effect July 1, 2022.

Participants will learn about FDA-approved tobacco treatment medications and how to deploy them in behavioral health settings. The event will also cover professional ethics and how they fit with tobacco use treatment, as well as trauma-informed tobacco use treatment and policies. Then, through experiential training methods, participants will develop policy planning, implementation and quality improvement skills to integrate tobacco treatment into the behavioral health system.

NCMS Legislative Update

While last week was supposed to be a lighter week at the General Assembly, several health-related bills did continue to move through committee.

HB96--Allow Pharmacists to Administer Injectable Drugs, was heard in the Senate Health Committee and referred to Senate Rules. The NCMS has been working with a variety of stakeholder groups to modify this bill and has been able to make several positive changes. Review the details of its progression here.

The NCMS lobbying team continues to work closely with several specialty societies to make changes to HB415 -- Update Chiropractic Laws.

SB711 -- NC Compassionate Care Act, which seeks to legalize medical marijuana, was heard in the Senate Finance Committee last week where the discussion focused on the financial aspects of legalization of marijuana for medical proposes. There are still several Senate committees that need to consider this bill before it would be presented on the Senate floor for a vote and possibly move to the House for consideration.

With many legislators out of town to attend a national legislative conference this week, it does promise to be a quieter at the legislative building. Watch your NCMS Morning Rounds for any news or check out our legislative blog for the status of key legislation we’re tracking.

Bringing the COVID-19 Vaccine Home

To help facilitate access to safe and effective COVID-19 vaccines for those who cannot leave home, the NC Department of Health and Human Services (NCDHHS) is partnering with Piedmont Triad Regional Council Area Agency on Aging (PTRC AAA) to provide free COVID-19 vaccinations to people with limited mobility. This new initiative expands PTRC AAA’s successful local at-home vaccination program to communities across the state.

Caregivers, providers, or individuals may access the program by calling the At-Home Vaccination Hotline at 866-303-0026 at any time or by visiting www.ptrc.org/covid and filling out the registration form.

Within three business days, a PTRC Vaccination Specialist will connect with the individual to schedule their at-home vaccination.

There is increasing urgency for people to get vaccinated against COVID-19 as the highly contagious Delta variant is rapidly spreading in North Carolina. Clinical trials among thousands of people have proven that COVID-19 vaccines are safe and effective for anyone age 12 and over. All protect against severe illness, hospitalization and death from COVID-19, including the Delta variant. More than 160 million Americans have been safely vaccinated.

Don’t Miss This EHR Incentive Opportunity!

Less than four months remain to apply for up to $8,500 through the NC Medicaid EHR Incentive Program.

Your practice would need to attest for Program Year 2021 as soon as possible. If the NC EHR Incentive Program receives the signed attestation by Aug. 31, 2021, the NC EHR Incentive Program will review the attestation, and if needed, conduct outreach before NC-MIPS closes on Oct. 31, 2021.

No attestations will be accepted after Oct. 31, 2021. There will be no exceptions to this Centers for Medicare and Medicaid Services (CMS) deadline.

NCMS Press Release: Physicians and PAs Stress the Importance of COVID-19 Vaccines for Adolescents

On Thursday, July 15, 2021, the NCMS issued a press release concerning the importance of COVID-19 vaccines for adolescents.

“The COVID-19 vaccine has proven safe and effective and is largely responsible for the return to normalcy we’ve been experiencing thus far this summer,” said NCMS President Philip Brown, Jr., MD. “It is crucial that anyone 12-years-old and older who has not yet been vaccinated against COVID-19, get vaccinated so they can return to learning and socializing in an environment safe from the virus and beneficial to their intellectual and social development.”

CMS Proposes Physician Payment Rule to Improve Health Equity, Patient Access

CMS is proposing changes to address the widening gap in health equity highlighted by the COVID-19 Public Health Emergency (PHE) and to expand patient access to comprehensive care, especially in underserved populations. In CMS’s annual Physician Fee Schedule (PFS) proposed rule, the agency is recommending steps that continue the Biden-Harris Administration’s commitment to strengthen and build upon Medicare by promoting health equity; expanding access to services furnished via telehealth and other telecommunications technologies for behavioral health care; enhancing diabetes prevention programs; and further improving CMS’s quality programs to ensure quality care for Medicare beneficiaries and to create equal opportunities for physicians in both small and large clinical practices.

ASIST is the world’s leading suicide intervention training program and has seen continuous improvements reflecting advances in counseling theory and adult learning. ASIST participants learn to recognize when someone may be at risk of suicide and respond in ways that help increase their immediate safety and link them to further help. Power Hour: Transgender Health Equity

In our continuing effort to explore timely issues that impact you and your patients, our Power Hour tomorrow, Friday, July 16, at noon, will focus on transgender health equity.

Transgender individuals routinely face discrimination and high rates of violence and harassment as well as systemic barriers to full freedom and equality. Today, 40 states have pending or have passed anti-transgender legislation, including North Carolina.

Our session will focus specifically on health equity for the transgender population, which, studies show, often experience ignorance of and disregard for their health care needs. Insurance companies routinely deny payment for surgery and other services for transgender individuals.

Legislation Reinstates Previously Waived Requirements

Effective July 29, 2021, Session Law 2021-62 (NC Senate Bill 594), repeals portions of the 2020 COVID-19 Recovery Act that permitted the temporary lifting of certain enrollment requirements for health care professionals enrolling in NC Medicaid during the global health care emergency.

The Public Health Emergency/Disaster Relief Provider Enrollment Application, an option made available to providers in March 2020, allowed for the limited-time enrollment of those who rendered services to NC Medicaid beneficiaries during the COVID-19 global pandemic (not including clinicians who see NC Medicaid beneficiaries on a regular basis).

Effective July 29, 2021, disaster applications will no longer be accepted, and those who were enrolled in NC Medicaid with the disaster relief application will be terminated effective July 28, 2021.

Additionally, the NC Medicaid  enrollment criteria suspended for all health care professionals under House Bill 1043 will be required again effective July 29, 2021. Therefore, in-person  site visits and fingerprint-based criminal background checks will resume for physicians and PAs in accordance with the Provider Permission Matrix, located on the Provider Enrollment page of the NCTracks secure  portal.

Those who were enrolled under the waived site visit and fingerprinting requirements will be subject to full credentialing at a later date, yet to be determined, in order to continue participation in the NC Medicaid program. More details will be forthcoming.

The North Carolina Department of Health and Human Services (NCDHHS) has exciting opportunities currently available for the positions of Disability Medical Consultant and Psychological Consultant. These positions are assigned to the NC Disability Determination Services (DSS) and are responsible for making medical determinations on disability claims for the Social Security Administration and State Medicaid Office.

As a Disability Medical Consultant, there is no direct patient care. Instead, Disability Medical Consultants work with a team reviewing cases to decide whether or not the medical evidence is adequate to make a disability determination. After completing an eight-week training session, the medical consultant will work with a team reviewing cases to decide whether or not the medical evidence is adequate to make a disability determination according to the Social Security Act policies. The review is completed in an electronic environment.  Position requires a degree from an accredited school of medicine and a current license to practice medicine in the state of North Carolina or the ability to obtain a license to practice medicine in the state of North Carolina, during probationary period.

Psychological Consultants are needed to review claimant records and use their medical experience, expertise, and judgement to assist in using that evidence to determine the severity of impairments and residual functional capacity according to the Social Security Act policy. As a Psychological Consultant, you work with a team and do not have direct patient care. Reviews are completed in an electronic environment using a computer. Psychological Consultants engage onsite at the DDS in an eight-week training period followed by ongoing support and coaching after the training period is complete. Position requires a doctoral degree in Clinical Psychology from an accredited institution and current license to practice medicine in the state of North Carolina or the ability to obtain a license to practice medicine in the state of North Carolina, during probationary period.

After the training period is complete, consultants may request Flexible Working Schedules or telework arrangements in accordance with DHHS policy.

Key Milestone Dates for NC Medicaid Managed Care

Aug. 1, 2021 – Beneficiaries have 30 days from receipt of notification of their Advanced Medical Home (AMH) assignment to change their AMH/PCP without cause (1st instance) and shall be allowed to change their AMH/PCP without cause up to one time per state fiscal year thereafter (2nd instance). In addition, Members shall be allowed to change their AMH/PCP with cause at any time.

Aug. 30, 2021 – Last date by which the health plan will pay claims and authorize services for Medicaid-enrolled out-of-network providers equal to that of in-network providers (or until end of episode of care, whichever is less)

Sept. 29, 2021 – Last date by which the health plan must honor existing and active prior authorizations on file with the North Carolina Medicaid or NC Health Choice program (or until the end of the authorization period, whichever occurs first)  

Sept. 30, 2021 – End of beneficiary choice period.

North Carolina Immunization Program (NCIP)

The North Carolina Immunization Program (NCIP) works in conjunction with the federal vaccine supply program, called the Vaccines for Children (VFC) program. The VFC program is a federal initiative created to help families of children who may not otherwise have access to vaccines by providing free vaccines to doctors who serve them.

The VFC program:

  • Provides federally purchased vaccine, for eligible children, at no charge to public and private providers;
  • Automatically covers vaccines recommended by the Advisory Committee on Immunization Practices (ACIP), established by resolution and approved by the Centers for Disease Control and Prevention (CDC);
  • Saves parents and enrolled providers out-of-pocket expenses for vaccine purchases; and
  • Reduces or eliminates vaccine cost as a barrier to vaccination of eligible children.

NC Medicaid is extending COVID-19 temporary provider rate increases for all providers except hospitals and clinical coverage policies through July 31, 2021. While the rate increases for providers authorized under SL 2020-4 were set to expire on June 30, 2021, NC Medicaid has discretion to continue these and other temporary rate increases assuming budget availability. NC Medicaid will continue to provide updates in July on the status of these increases and may end the legislated or other rate increases at the end of July if these rate increases are not funded by the NC General Assembly.

Note: FQHCs’ unique Core/T1015 rates are increased by 5% effective July 1, 2021 as part of the temporary COVID-related rate increases. Those FQHCs who elected an Alternative Payment Methodology increasing their PPS rates by 43% will still have those enhanced rates continued for the duration of the Public Health Emergency.

NCMS Legislative Update

 

We’ve gone ‘Live’ with Medicaid Transformation. The go live date happened Thursday, July 1 and started the Medicaid Managed Care process here in North Carolina.

The NCMS has developed a Medicaid Transformation landing page where you can access a wealth of information to help guide you and your practice. Additionally, we have created a Medicaid Transformation Issues form to log any specific issues you are encountering during this transformation. Information we compile from these online forms will be used to better serve you and your patients as we undergo this transition.

HB453 (Human Life Nondiscrimination Act/No Eugenics) was vetoed by the governor. As a reminder, this bill is opposed by the NCMS and the North Carolina Obstetrical & Gynecological Society due to its interference with the physician-patient relationship. This bill was not brought up for an override vote. We will continue to follow this bill, because it’s likely there will be a vote to override.

HB159 (Education Law Changes) There’s a piece in this bill that will aide our school nutrition colleagues in better serving students and enabling more flexibility in their monetary and budget process. Standing alongside the NC School Nutrition Association, the NCMS supports this bill. HB159 moved through Senate Finance but has a few more stops in the process.

SB711 (NC Compassionate Care Act) This bill was previously heard for discussion only in the Senate Judiciary Committee. Last week in the Senate Judiciary Committee it was passed unanimously. This bill will now move onto the Senate Finance Committee.

The NCMS policy is to support more research as it relates to marijuana. You can lookup up specifics of our policy in our NCMS Policy Manual.

SB257 (Medication Cost Transparency Act) The NCMS is supportive of this bill, because it provides greater oversight and regulation of the Pharmacy Benefit Managers (PBM). We believe more oversite into these entities will reduce medication costs for patients. This bill moved forward from committee last week and is moving on to the House Health Committee.

New Healthy NC Initiatives

The North Carolina Medical Society (NCMS) and the NCMS Foundation are committed to the population health improvement goals outlined in the NC Institute of Medicine’s Healthy NC 2030. In support of this plan to improve the health and well-being of North Carolinians, we are developing our own Healthy NC initiatives. The first part of this multi-faceted project begins this week as we work with our Community Practitioner Program (CPP) participants to gather data on key health metrics among their patient populations.

Initially, we will engage with five CPP practices, located in underserved areas of the state where patients may face multiple challenges to optimizing their health, and with the Cabarrus County Health Department. We have developed a survey to be used by each CPP practice to gather data on the social determinants of patients’ health. This is an invaluable source of information on the current health environment and behaviors of patients and will help benchmark our progress as we seek to enhance our existing resources and develop new initiatives aimed at improving health as part of Healthy NC.

Providers Must Complete Health Equity Payment Initiative Survey by July 16 or Risk Payments Being Recouped

All Carolina Access Providers who received health equity payments are asked to take 5-10 minutes to complete this survey by July 16, 2021. The survey allows DHHS to monitor and evaluate how these payments were used. Practices receiving enhanced payments must complete a practice survey following this health equity initiative; failure to complete the survey may result in NC DHHS recouping payments.

Today’s the Day – Medicaid Managed Care Is ‘Live!’

The long-awaited transition to Medicaid managed care in North Carolina happens today. In advance of this change, the NCMS and our partner organizations have a webpage with valuable resources to help your practice have a smooth transition as well as a special form on which to register any persistent problems. The NCMS along with the NC Academy of Family Physicians, the NC Pediatric Society and the NC Psychiatric Society issued a joint media statement yesterday on this momentous change. Read the statement here.

New Study Shows 70 Percent of Physicians Nationwide Now Employed 

Nearly 70 percent of U.S. physicians are now employed by hospital systems and corporate entities like private equity firms and health insurers according to a new study by Avalere for the Physicians Advocacy Institute (PAI) examining the two-year period between Jan. 1, 2019 and Jan. 1, 2021.

The research found the COVID-19 pandemic accelerated a long-term national trend of hospitals and

corporate entities acquiring physician practices and employing physicians. During the two-year period studied, these entities acquired 20,900 additional physician practices. Forty-eight thousand additional physicians left independent practice for employment by hospital systems or other corporate entities.

“COVID-19 exacerbated financial vulnerabilities of physician practices and forced them to make difficult

decisions,” said Kelly Kenney, chief executive officer of PAI. “The practice acquisition trend has

potentially serious implications for competition and health care costs, which have been shown to increase with this type of marketplace consolidation.”

Every U.S. region experienced these national trends of steady growth in employment and acquisitions,

with an uptick in the last half of 2020. The study also looked at data for individual regions of the US, revealing that the South has the highest percentage of corporate employed physicians at more than 23 percent and had the biggest increase in physician employment with more than 40 percent growth. Our region also experienced the biggest increase in practice acquisitions by corporate entities with 59 percent growth.

The cumulative findings by Avalere researchers during the two-year period revealed:

  • Hospitals, health systems and corporate entities now own nearly half of the nation’s medical

practices.

  • The sharpest increase in physician practice acquisitions and employment was among corporate

entities such as private equity firms and health insurers (32 percent).

  • Across regions, hospital ownership of practices grew between 6 percent and 11 percent and

corporate ownership grew between 44 percent and 59 percent.

PAI highlighted the findings in a letter to Congress and has pledged to work with Congress and state policymakers to champion policies that enable physician-led organizations and independent physician practices to compete with larger corporate entities to deliver health care services to patients.

“Regardless of the practice setting, physicians must retain autonomy to make clinical

decisions, free from interference by corporate entities motivated primarily by profits,” said Kenney.

PAI and the NCMS, which plays an active role in PAI, are examining these trends as part of an ongoing effort to better understand how physician employment and health care consolidation affects the practice of medicine as well as implications on health care costs and spending. New Blue Cross NC Joint Venture Aims to Help Independent Practices

Earlier this week, Blue Cross and Blue Shield of North Carolina (Blue Cross NC) announced a new joint venture with Deerfield Management Company, a health care investment firm, to provide services to support independent physician practices and help them succeed in the move to value-based care. The venture will leverage Deerfield’s research and operational capabilities, such as the Deerfield Institute and its External Operations Team, and represents the next phase of Blue Cross NC’s efforts to work with providers “to make health care better, simpler and more affordable,” according to a Blue Cross NC press statement.

“Independent physicians in North Carolina have an especially difficult burden when it comes to managing their practices without the resources and scale that come with being part of a larger organization,” said Tunde Sotunde, MD, Blue Cross NC president and CEO, in the official statement. “We want to empower independent physicians – especially primary care – by offering a new level of support to help them lead their practices in a time of great change in health care. This new organization will fill a void for practices that are independently owned and will help them thrive.”

Deerfield partner Adam Grossman added: “We are excited to join forces with Blue Cross NC, a national leader in the transition to value-based care, in our shared vision to create an organization that supports and strengthens independent providers. This joint venture aims to improve access to high-quality primary care while ultimately reinforcing the importance of the provider-patient relationship.”

The new venture will:

  • Provide infrastructure and support services to reduce administrative burdens and alleviate physician burnout
  • Equip physicians with integrated technology solutions to monitor, manage and coordinate patient care effectively
  • Share data and insights alongside value-added services to identify and address opportunities to improve care
  • Offer flexible options to help physicians structure the management and ownership of their practices

Assistant Surgeon General to Give Keynote Address at Oral Health Day 2021

The North Carolina Oral Health Collaborative (NCOHC) has announced that Assistant Surgeon General Dr. Timothy L. Ricks will give the keynote address at their annual event, Oral Health Day, on July 21, 2021. RADM Ricks is scheduled to discuss the state of oral health, inequities and barriers facing Americans, COVID-19’s impact on care, and opportunities for innovation in his address.

Oral Health Day is an annual event hosted by NCOHC, a program of the Foundation for Health Leadership & Innovation. The event features speakers with expertise in innovative approaches to improve equity and access to oral health care.

VAXELIS Now Available Through the NC Vaccines for Children Program (VFC)

VAXELIS is a vaccine indicated for active immunization to prevent diphtheria, tetanus, pertussis, poliomyelitis, hepatitis B, and invasive disease due to Haemophilus influenzae type b (Hib). It’s approved for use as a 3-dose series in children 6 weeks through 4 years of age (prior to the 5th birthday). VAXELIS is the first-and-only hexavalent vaccine approved by the FDA. It’s also included on the CDC's list of ACIP approved vaccines.

NCMS Legislative Update

Last week the Senate budget was released. At over 400 pages, it’s a lengthy bill. A summary is available on our legislative blog. The Senate included exclusive provider organization (EPO) language that has already passed the Senate but has not been taken up in the House yet. SB505 (Medical Billing Transparency) was also included word for word. This is a negotiating tool often used both on the House side and Senate side, including policy in the budget as a negotiating tool between the two chambers. We will be following closely throughout the process.

SB711 (NC Compassionate Care Act) received a committee hearing this week. This bill would allow the use of medical marijuana in North Carolina for certain types of conditions. For more details and specifics about this bill, be sure to visit our legislative blog. NCMS policy states that we support research. This bill does include a specific piece on the research component within the UNC system. We are supportive of that piece. Our Ethical and Judicial Affairs committee is creating a subgroup to look into this issue in more detail. Be sure to watch your email for an opportunity to provide input on this issue. This bill did not receive a committee vote. It was heard for discussion only.

NCMS President Philip Brown, MD, made several legislative visits over a two-day period last week. He met with several legislators on your behalf, as well as on the behalf of the NCMS. We would love to have each of you at the legislative building, so be sure to register for a White Coat Day.

New Telehealth Legislation Introduced in Congress

In late May, two new telehealth bills were introduced in Congress: The Telehealth Improvement for Kids’ Essential Services (TIKES) Act of 2021 and The Permanency for Audio-Only Telehealth Act. The push toward permanently expanding certain telehealth flexibilities is partially consistent with Medicare Payment Advisory Commission’s recommendations to extend the flexibilities for further evaluation to first determine whether they should be permanently extended. It is also indicative of Congress being amenable to making some telehealth policies permanent. Both bills are summarized below:

HHS Releases Revised Reporting Requirements and Timeline for Provider Relief Fund

White House Conversation: North Carolina Primary Care Providers and the Vaccination Rollout

On behalf of the White House COVID-19 Response Team and North Carolina Governor Roy Cooper’s Office, you are invited to a virtual conversation on North Carolina Primary Care Providers and the Vaccination Rollout. The event is on Tuesday, June 29, from 4:00 – 5:00 PM ET.

The conversation will be an opportunity to express gratitude to North Carolina’s primary care providers for their service to their patients, state, and country throughout the COVID-19 response and vaccine rollout. Speakers will discuss the critical role primary care providers continue to play in this phase of the vaccination effort -- including through vaccine education to their patients and through offering vaccinations in their offices -- and the tools the federal government and State of North Carolina are providing to support them. Attendees will hear from fellow primary care providers in North Carolina on innovative approaches they are taking to patient outreach and implementing their own vaccination programs. Additionally, attendees will be able to pose questions about the role of primary care providers in the current phase of the vaccination effort and the challenges or concerns they face.

Vaccination Counseling Code Reimbursement

Effective June 22, 2021, CPT 99401: Preventative medicine counseling and/or risk factor reduction intervention (s) provided to an individual, up to 15 minutes has been added to counsel Medicaid beneficiaries regarding the benefits of receiving the COVID-19 vaccine.

CPT 99401 can be billed at only one visit for each beneficiary per day, but there are not quantity limits for the number of times this education is provided to an individual beneficiary.

Providers must bill CPT 99401 with a CR modifier and there is no requirement for a specific diagnosis code.

Providers are encouraged to counsel Medicaid beneficiaries of any age. Parents or guardians of Medicaid children can be counseled on the benefit of receiving the COVID-19 vaccination even if the parent or guardian is not enrolled in NC Medicaid. The counseling session for the parent or guardian can be billed to the child’s Medicaid ID.

This service can be provided by MD/DO, NP, PA, CNM and if provided at LHD, FQHC or RHC will be reimbursed outside of the PPS rate.

Call for Nominations: NCMS Foundation Board of Trustees 

Overview

The call for nominations for individuals to serve on the NCMS Foundation Board of Trustees is now open. Nominations are due by August 30, 2021 (view NCMS Foundation Candidate Application Form).

The North Carolina Medical Society Foundation (NCMSF) is the philanthropic arm of the North Carolina Medical Society. The mission of the NCMSF is to improve access to quality health care for all North Carolinians. Our portfolio of programs demonstrates our commitment to this vision. Learn more about each of these programs here.

Those who serve on the NCMS Foundation’s Board of Trustees have general experience with and understanding of a philanthropic, 501c3 organization. Trustees are willing and able to articulate the purpose of each of the Foundation’s initiatives, and, ideally, will be able to offer details about their firsthand experience with a particular NCMS Foundation program and the value it brings to the profession and to North Carolina. Knowledge about the challenge’s health care professionals and their patients face and a desire to be innovative and collaborative in finding solutions is essential to this role. Fundraising ability also is crucial to fulfilling the Foundation’s mission of improving access to quality health care for everyone in the state.

In 2021, the NCMS Foundation will be filling the following leadership positions:

Trustee: Up to four (4) Trustees to serve three-year terms.

Process:

Step 1: Candidates are nominated or may nominate themselves for a position on the NCMS Foundation Board of Trustees (view NCMS Foundation Candidate Application Form).

Step 2: Once a candidate submits their application form, they will receive a confirmation and be made aware of any follow-up needed.

Step 3: Upon careful review of submitted materials, the NCMS Foundation Board Development Committee will select candidates to be interviewed. Interviews will take place via videoconference on September 14, 2021.

Step 4: Following candidate interviews, the NCMS Foundation Board Development Committee will vote to select candidate(s) to fill open leadership positions. The NCMS Foundation Board of Trustees will approve the slate of candidates at its next board meeting.

All nominations and any information collected as part of the nominating process is strictly confidential.

Physicians Foundation Releases Study on Merit-Based Incentive Payment System 

On May 14, the Physicians Foundation released a study on the time and financial costs for physician practices to participate in the Medicare Merit-Based Incentive Payment System (MIPS). The MIPS track of the Medicare Quality Payment Program (QPP) influences payment for more than 1 million physicians annually. There is growing concern that MIPS increases administrative burden, and little is known about what it costs physician practices to participate. Research published by the Foundation examines this issue using interviews from December 2019 to June 2020 with leaders of 30 physician practices across the U.S. Key findings from the study include:

  • An average of $12,811 was spent per-physician to participate in MIPS in 2019; small and medium primary care practices had mean per-physician costs of $18,466 and $13,631 respectively.
  • Physicians and administrators spent more than 200 hours per physician on MIPS-related activities.
  • Physician time accounted for the greatest proportion of overall MIPS-related costs with a mean cost of $6,909.
  •  Average MIPS-related costs were substantial, totaling $1,111 per physician.

HHS Awards $125 Million in Workforce Grants for Community-Based Efforts to Bolster COVID-19 Vaccinations in Underserved Communities

V-safe is a smartphone-based tool that uses text messaging and web surveys to provide personalized health check-ins after someone receives a COVID-19 vaccination. Through V-safe, vaccine recipients can quickly tell CDC if they have any side effects after getting the COVID-19 vaccine. Depending on their responses, CDC may follow up with them by phone to get more information. V-safe will also remind them to get their second COVID-19 vaccine dose, if needed.

2019 Quality Payment Program (QPP) Performance Information Now Available on Care Compare

The Centers for Medicare & Medicaid Services (CMS) has added new Quality Payment Program performance information for doctors, clinicians, groups, and Accountable Care Organizations (ACOs) to the Doctors and Clinicians section of Medicare Care Compare and in the Provider Data Catalog (PDC). CMS is required to report MIPS eligible clinicians’ Final Scores, MIPS eligible clinicians’ performance under each MIPS performance category, names of eligible clinicians in Advanced APMs and, to the extent feasible, the names and performance of such Advanced APMs. Performance information for doctors and clinicians is displayed using measure-level star ratings, percent performance scores, and checkmarks.

OSHA Announces Long-Awaited Standards on How Employers, including CHCs, Must Protect Staff from COVID

On Thursday June 10, the Occupational Safety and Health Administration (OSHA) released a long-awaited “emergency temporary standard” (ETS) outlining how employers must protect employees from exposure to COVID.  The ETS applies to all health care employers – including CHCs. OSHA also issued safety guidelines for non-health care businesses, but unlike the rules for health care employers, those are optional.

NCMS Legislative Update

As usual, a lot is happening at the General Assembly. As of last Friday, the Senate budget was expected to be released late Sunday (June 20) or early today and will likely be voted on later in the week. Stay tuned to our legislative blog, as we’ll have an analysis document and a link to the full version of the budget. Please keep in mind, this budget has a long way to go and is just a starting point from the Senate side.

HB96 (Allow Pharmacists to Admin. Injectable Drugs.) was heard in the Senate Health Care committee and was voted out favorably. This bill has an amendment that includes several items the NCMS has requested be a part of this new bill version. One significant change to the bill states that instead of allowing pharmacists to prescribed certain medications, it would have to be done under a standing order by the State Health Director. HB96 is supposed to go to the Senate Commerce and Insurance Committee next. Due to the Senate budget coming out, it’s unclear if the committee will take up the bill this week. If so, we think additional changes we’re requesting will be made to this bill at that time.

We’re projecting a busy week with the House Health Committee being calendared, along with the Senate budget. We’ll have a lot to report to you. Stay tuned!

Resource For Your Vulnerable Patients: Operation Fan and Heat Relief

Individuals age 60 and older, as well as adults with disabilities, are eligible for fans to provide relief from the heat from now through October 31. As individuals age and develop chronic medical conditions, they are less likely to sense and respond to changes in temperature. They may also be taking medications that can worsen the impact of extreme heat. Operation Fan and Heat Relief helps vulnerable adults at risk for heat-related illnesses stay safe during the summer. Eligible individuals can request a fan through their local county agency.

NCDHHS Prioritizing Equity in COVID Testing, Vaccine Strategies

NCDHHS has made equity a priority in testing and vaccine rollout efforts for high-priority and marginalized populations throughout the COVID-19 pandemic.

As outlined on PreventEpidemics.org, NCDHHS established an equity-driven testing strategy that sought to provide access to testing in communities most affected by COVID-19 early in the pandemic. To rapidly scale up COVID-19 testing and make it more equitable, NCDHHS started its Community Testing for High-Priority and Marginalized Populations (CHAMP) initiative in July 2020.

The CHAMP initiative provided a blueprint for the NCDHHS to design an equitable COVID-19 vaccine rollout: engage with communities to identify needs, look at the data to drive decision-making and adjust the program in real-time as needed.

Home Testing Program Expands to All Eligible North Carolinians

NCDHHS is expanding the availability of its at-home COVID-19 test collection. All North Carolina residents may request a COVID-19 PCR Test Home Collection Kit shipped overnight directly to their homes at no cost.

Mandatory use of NC Controlled Substances Reporting System in effect July 7

A STOP Act requirement to check the NC Controlled Substances Reporting System (NC CSRS) before prescribing certain controlled substances will be in effect as of July 7. Read the North Carolina Medical Board (NCMB) notice here.

Physicians, physician assistants and other controlled substances prescribers who are not already registered and using NC CSRS should register now to ensure they are in compliance by July 7.

Campbell University Brings Vaccinations and Primary Care to Mt. Olive With New Mobile Clinic

Campbell University School of Osteopathic Medicine’s brand new Mobile Health Education Clinics (MHEC) debuted during a week-long local mission trip May 31-June 1 serving migrant farm workers and their families in Mt. Olive, NC.

The MHEC fleet includes two 40-ft. clinic vehicles and a 26-ft. clinic vehicle. The 40-ft. vehicles each have a waiting room, two full-sized patient rooms, and are equipped to provide services available in a family physician’s office – from general health screenings to minor surgical procedures.  The clinic vehicles are complimented by a tent system that provides additional patient waiting, treatment and education space.

This has afforded us the ability to really expand,” shared Dr. Joe Cacioppo, chair of community and global health and associate professor of emergency medicine. “We are 100 percent equipped to do full-fledged primary care for communities that have no access to healthcare otherwise.”

NCSU MBA Survey

NC State University and the North Carolina Medical Society (NCMS) are seeking your help to guide decisions about a future professional development opportunity. NC State is considering offering an online MBA program targeted at the needs of health care professionals. The program would cover essential business topics such as finance, leadership, marketing and operations. It also would offer courses in health care markets, health care innovation, health care equity, leadership, design thinking and systems thinking.

The health care MBA would cost the same as NC State’s current online MBA.  No standardized test scores would be required for admission decisions.  At the completion of the program, graduates would be able to advance in a health care organization, manage their own practice or start their own enterprise. We would appreciate your feedback regarding this program. This survey should take approximately 5 minutes to complete.

Teams Engineer Complex Human Tissues, Win Top Prizes in NASA Challenge

Kudos to Wake Forest Institute for Regenerative Medicine!

Two teams of scientists from the Wake Forest Institute for Regenerative Medicine (WFIRM), led by NCMS member Dr. Tony Atala, in Winston-Salem, North Carolina, have won first and second place in NASA's Vascular Tissue Challenge. The prize competition aims to accelerate tissue engineering innovations to benefit people on Earth today and space explorers in the future.

Competing as teams Winston and WFIRM, each used a different approach to create lab-grown human liver tissues that were strong enough to survive and function in ways similar to those inside the human body. The teams each used a varied 3D printing technique to construct a cube-shaped tissue about one centimeter thick and capable of functioning for 30 days in the lab.

The NC Chapter of the American College of Physicians (NCACP) is excited to introduce a 7-month series “Words for Wellness”. The NCACP is partnering with Laura Hope-Gill, MFA, the Director of the Thomas Wolfe Master of Fine Arts and Certificate Program in Narrative Healthcare at Lenoir-Rhyne University.

During these Zoom sessions, there will be alternating opportunities for both poetic medicine and narrative medicine where some sessions will have a chance to read and discuss a piece of poetry or prose related to our work in medicine. Others will be an opportunity to write our own thoughts on paper about the work we do. Attendees will meet every third Thursday of the month through the end of the year. This is also a wonderful opportunity to help doctors who are interested in building Narrative Medicine into their teamwork or teaching.  You do not need any experience in writing to join these sessions.

June 24 Deadline to Apply for Health Center Construction and Capital Improvements (C8E) Funding

Health centers have until Thursday, June 24, to submit their ARP – Health Center Construction and Capital Improvements (C8E) application in EHBs. Visit the HRSA C8E TA webpage for award submission guidance, recordings of the question and answer sessions, and other resources. See the recently updated C8E FAQs webpage. Capital Link, a HRSA-funded National Training and TA Partner (NTTAP), recently hosted webinars to support health centers with their applications.

Governor Cooper shared an exciting announcement to motivate those who have not yet been vaccinated — and thank those who have! As part of North Carolina’s effort to Bringing Summer Back with safe, effective and free COVID-19 vaccines, North Carolina is launching the Your Shot At a Million Summer Cash Drawings. Four vaccinated North Carolinians 18 and older will win $1 million each and four North Carolinians ages 12 to 17 will win $125,000 for post-secondary education.

Medicaid Managed Care PHP Auto-Assignment

Medicaid beneficiaries who are transitioning to managed care who did not select a pre-paid health plan (PHP) during Open Enrollment have been auto-assigned to a plan. Click here to view the PHP enrollment summary. Beneficiaries have until September 30, 2021 to switch to a different PHP, whether they actively selected a plan or were auto-assigned to a plan. To switch to a different PHP, beneficiaries should contact the Enrollment Broker at 1-833-870-5500.

Additionally, beneficiaries have two “without cause” opportunities to switch their primary care provider (PCP). They can switch their PCP by August 1, 2021, as well as one additional time. To switch to a different PCP, beneficiaries should contact their PHP.

Beneficiaries can also switch their PHP and PCP during their annual Medicaid recertification.

NCMS Legislative Update

The Legislature was back this week for another busy week. The House and Senate have stated they have reached a budget number agreement. We’re likely to see a Senate budget either this week or next.

There were several committee meetings last week. We want to point out a few bills. The first is HB96 -- Allow Pharmacists to Admin. Injectable Drugs. This bill was combined with pieces (along with new parts) of SB575 --Pharmacists Improve Public Health Needs. It was introduced for discussion only, with several changes requested by the NCMS, North Carolina Medical Board (NCMB), and many other physician and PA specialties that have been involved on this issue. Improvements to this bill will continue to be made, and the bill will likely be heard in Senate Health Committee this week. Thank you if your specialty or society has been engaged in this process.

Another bill that moved was HB453 --Human Life Nondiscrimination Act/No Eugenics. As previously mentioned, the Senate voted on this bill, and it has been sent to the governor. The NCMS is asking Governor Cooper to veto this bill due to its interference with the physician-patient relationship. We’ll keep you updated.

FDA Approves Higher Dosage of Naloxone Nasal Spray To Treat Opioid Overdose

The U.S. Food and Drug Administration recently announced the approval of a higher dose naloxone hydrochloride nasal spray product to treat opioid overdose. The newly approved product delivers 8 milligrams (mg) of naloxone into the nasal cavity. The FDA had previously approved 2 mg and 4 mg naloxone nasal spray products.

Naloxone is a medicine that can be administered by individuals with or without medical training to help reduce opioid overdose deaths. If naloxone is administered quickly, it can counter the opioid overdose effects, usually within minutes.

$25 Cash Cards Offered at Select Vaccine Sites in Four Counties

As part of its ongoing effort to get more North Carolinians vaccinated and safely bring summer back, NCDHHS is offering $25 Summer Cash Cards at select vaccine sites to offset the time and transportation costs of getting vaccinated.

Select vaccine sites will offer Summer Cash Cards in a limited number of vaccination sites in Mecklenburg, Guilford, Rowan and Rockingham counties through June 8. Anyone 18 and older who gets their first dose of a COVID-19 vaccination — or drives someone to their vaccination — will receive a $25 cash card after vaccination at a participating location while supplies last. Cards are for the first dose only for both the person being vaccinated and the driver.
