SB 157 – Amend Laws Regarding Mental Commitment Bars

This bill seeks to change the process for individuals who want to remove firearm restrictions after restoration to competency. For relief from a judicial determination involving mental illness, this bill would allow an individual to file a petition with a district court judge after the completion of an inpatient or outpatient commitment. After the restoration to competency entry, this bill states that an individual may submit a written request to the clerk to update the individual’s record in the National Instant Criminal Background Check System (NICS). After the clerk verifies the individual has been restored to competency, the clerk shall update the individual’s record in NICS.
